In Portugal, a civil partnership entitles the partners to a few rights, but not as many as marriage.

One of the rights that is not recognized by law is the right to inherit.

According to the Portuguese Civil Code, the legitimate heirs are the spouses, descendants and ascendants. In their absence, siblings and their descendants are called.

Therefore, if one of the members of the civil partnership passes away without a will, the other is not entitled to any part of their estate. The only way to ensure that the remaining civil partner receives their share of the estate is through estate planning.

In addition to civil partnership situations, the importance of estate planning is particularly clear when it comes to avoiding family disputes.

Estate planning is the procedure of organizing your assets and rights so that they are passed on to your heirs in the most efficient and secure way possible.

Estate planning involves legal, tax and family issues, and requires a careful analysis of your needs and objectives. Some of the advantages of estate planning are:

- Avoiding conflicts between your heirs, ensuring that your wishes are respected;

- Reducing the costs and taxes of inheriting;

- To safeguard your assets against possible creditors or third-party claims;

- To maintain the asset's worth by preventing its devaluation or deterioration;

- To make it easier to manage the assets by appointing an administrator or executor;

- To anticipate disability situations by appointing a proxy or guardian;

- To establish who will look after your pets.
